Building Inspection - Special Condition

It is very important when purchasing a home subject to a building inspection or pest inspection that you have an appropriate special condition.

You should seek your Solicitors advice to make sure that the special condition inserted into the contract actually provides you with the legal protection you require, should the findings of a professional inspection prove unfavourable.

A popular special condition used in Victoria for sales subject to building inspections and approved by the Law institute of Victoria is as follows:

"This sale is subject to the Purchaser obtaining a building report within seven days of the Purchaser signing this Contract. If the report shows a major structural defect the Purchaser may end this contract but only if the Purchaser serves written notice on the Vendor together with a copy of the report within seven days of the Purchaser signing this Contract. All monies must be immediately refunded to the Purchaser if the contract is ended."
